Definition of
Pursuant to Section 833 of the German Civil Code (BGB), animal owner liability is basically strict liability, i.e. the animal owner is liable for damage caused by his animal, even if he has kept or supervised the animal properly. In this case, he is not at fault.
Liability of the pet owner for luxury animals
There is strict liability for a luxury animal in accordance with Section 833 BGB (1). A luxury animal is an animal that is either not to be regarded as a pet or, as a pet, is not intended to serve the owner's profession, gainful employment or maintenance. This also includes exotic animals.
Liability of the animal keeper
The animal keeper is the person who has taken over the supervision of the animal § 834 BGB (1). In this case, there may be double insurance from the animal keeper's liability insurance and the private liability insurance of the animal guardian.
Infringement of keeper obligations
These are obligations imposed by the state or federal state which must be complied with (e.g. compulsory use of a lead, height of the paddock).
Deck damage
Dog owners whose dogs cause damage at stud are obliged by law to bear the associated costs and compensation claims. This type of damage can occur with intentional or unintentional mating.
Damage to movable property
In the context of dog liability insurance, the term rental property damage refers to all damage caused by a dog to furnishings in rented flats or other rented premises that are used privately.
Riding participation
A riding partner is a third party who contributes to the maintenance costs of the horse by providing constant care or by making constant financial contributions and who also rides the horse himself.
Third-party rider risk
The risk of damage is increased, especially if the horse is ridden by a third party, simply because the horse and rider are often unfamiliar or barely familiar with each other. This also applies if only occasional strangers look after the insured horse or go for a short ride.
Field damage
Field damage is damage to an agricultural property or its crops, e.g. trampled fields, damage caused by bites on trees and bushes.
Insurance cover for puppies/foals in months
This is a benefit inclusion for puppies/foals. These are considered excluded in the General Terms and Conditions of Insurance for Pet Owners' Liability Insurance.
Compulsory insurance by the legislator
In the federal states of Berlin, Hamburg and Saxony-Anhalt, pet owner liability insurance for dogs is mandatory by law.
Exclusions
There is no insurance cover for damage caused intentionally. Furthermore, pet owner's liability insurance does not cover damage caused to the pet owner himself. If damage is caused to a close relative who lives in the same household as the policyholder, this is also not covered by the insurance.
